I HEREBY CERTIFY:
I
am at least 18 years of age and in good mental and physical health and if I am
under the age of 18 years of age, I will have a parent or guardian's signature
allowing approval to participate in the game.
IN RETURN FOR THE USE OF THE FACILITIES
AND/OR ANY OTHER CONSIDERATION, I STATE AND AGREE THAT:
a.
I am aware that the Paintball Action game (hereinafter
referred to as "Paintball Action") is a physically and mentally
strenuous game involving possible risk of injury from equipment, other players
and playing environment. I acknowledge that it is the intent of other players
at Paintball Action to assault me during the game and that in order to do so,
other players will try to overcome any resistance that I may exert by the
forceful use of paintballs by hand or air gun, referred to below, which gun is
powered by a C02 tank which can exert a pressure of 800 pounds per square inch
and a range of approximately 100 feet. The paintballs projected from such gun
measure approximately .68 inch in diameter and are made of a bio-degradable
shell and dye.
b.
I hereby undertake and assume total responsibility for any
risk or injury associated with playing or participating in Paintball Action.
c.
I undertake to play Paintball Action in accordance with the
safety instructions, rules and guideline which I hereby acknowledge as having
read and understood. (The referred to rules are on the reverse hereof).
d.
I am aware that Douglas Brecht does not warrant the
condition or safety of equipment, facilities or premises, natural and
constructed or the availability of emergency medical care, connected with
Paintball Action.
e.
I understand and acknowledge that Douglas Brecht and
Paintball Action Games Asquith, their respective officers, agents, employees
and associated personnel are NOT insured for any liability that may
attach to them by my having agreed to paticipate in Paintball action.
f.
I hereby for myself, heirs, executors, administrators,
successors and assignees INDEMNIFY and SAVE HARMLESS and keep indemnified
Douglas Brecht, Paintball Action Games Asquith, their equipment manufacturers,
suppliers, as well as the staff, agents, representatives, employees, promoters,
officers, directors, shareholders, guests, invitees, mandatories and assignees
of the aforementioned from and against any and all actions, claims, costs,
expenses or demands including legal fees, in respect of the death, injury, loss
or damage to the person or property of myself, or of any other participant or
guest, however caused, arising out of or in connection with my playing a
attending on the premises on which the offered air gun game, Paintball Action
is played and notwithstanding that the same may have been contributed to or
occasioned by the negligence of the said parties, their respective staff, instructors,
servants, officials, representatives, agents, officers, participants,
directors, shareholders, promoters, mandatories, guests, assignees, other
players, and which negligence may relate, without limiting the generality of
the foregoing, to the manufacture, selection, delivery, possession, use and
operation of equipment and supplies, and selection and maintenance of the
premises and the natural environment, and the conduct and supervision of the
air gun game.
g.
I expressly agree that the foregoing Waiver is intended to
be as broad and inclusive as is permitted by the law of the Province of
Saskatchewan in which air gun game is conducted and that if any portion thereof
is held invalid, it is agreed that the balance shall, nevertheless, continue in
full legal force and effect.
h.
I hereby certify that I have read and understand this Waiver
in its' entirety, and that I have executed same of my own free will without
incurring any duress whatsoever. I also acknowledge that I have the right to
withdraw from said game at any time.
i.
I consent to the free use of my photograph or other recorded
image or sound reproduction in any future promotional or advertising material
in such form and at such times as the air gun game promoters may in their sole
discretion determine, and I hereby waive any claim for compensation in respect
of such use.
j.
I further declare that this document has been drawn up in
the English language at my request.
k. I accept full
responsibility for return or replacement value of the loaned equipment upon termination
of the Paintball Action Games: Paintball Gun - $300; C02 tank - $50; Jacket -
$30; Pants - $30 Neck Protector - $5; Barrel Plug - $5; Belt and Pouch - $15
Mask- $50
l. I fully understand the risks and
potential for physical injury and harm associated with playing Paintball
Action.
m. I have read and fully understand this
agreement and recognize it is legally binding.

RULES
I
am aware of, understand and agree to be bound by the following safety rules,
conditions and understanding:
1.
Goggles MUST be worn at all times on the playing field.
2.
Barrel plugs MUST be in paintball guns at all times when off the playing field.
3.
NO shooting inside safe area or when entering safe area.
4.
When tagged out, players must call "HIT" , place barrel plug in end
of paintball gun barrel and walk off playing field with paintball gun held up
above the shoulder.
5.
When unsure whether a pellet has broken, a player can wipe the spot to check
for paint. If still uncertain, player may call "PAINTCHECK" and a
referee will check for a "HIT". Play continues unless the referee
calls for a halt in play.
6.
No player may shoot at a player who has called "HIT".
7.
All players are required to wear goggles, face masks, ear and neck covering,
and clothing covering arms and legs.
8.
Excessive Hits Rule: No player shall shoot a burst of more than 3 pellets at
any one player at one time. If more than 3 pellets in a single burst break on
another player, both the player who is hit, and the shooting player will be
called out.
9.
Head shots should be avoided when possible. Never shoot at the head unless it
is the only target available.
10.
Surrender Rule: If a player is within 10 feet of another player, either player
may ask to surrender to avoid being hit at a close distance. This has the same
effect as calling "HIT". The surrendering player must then put the
barrel plug in his gun, raise his gun over his shoulder and leave the playing
field for the remainder of the game.
11.
Private equipment on the field: Any player using his/her own equipment as
opposed to rental equipment on this field must have approval of the head
referee. This is for safety purposes. All paintball guns must be checked by
chronograph to ensure they are shooting under 300 fps. Personal protective gear
must meet PAGA safety standards. Smoke bombs or smoke grenades are not
permitted.
12.
Absolutely no alcohol allowed .
13. Only
field paint ,may be used.
14.
Renters may chose to use a rental Pump Paintball Gun instead of a rental
Semi-Auto Paintball Gun.
15. No
"Blind" firing. Players must be able to see where they are shooting
to.
16.
No physical contact between players other than a light tag to the back
or shoulder to eliminate a player from the game.
SPORTSMANLIKE CONDUCT IS EXPECTED AT ALL
TIMES. Players who do not behave in a sportsmanlike manner, following all field
rules and treating other players and staff with respect may be required to hand
in all equipment and be expelled from games for the remainder of the day.

paintball.. I understand that by making this agreement I surrender valuable
rights. I do so freely and voluntarily.
